Fermiamo la Pena di Morte

Presto Amrozi Bin H. Nurhasym, accusato di essere uno degli autori della strage di Bali, in Indonesia, nel 2002, potrebbe essere messo a morte.

Vorremmo diffondere questo appello semplicemente perché ci opponiamo alla pena di morte e affinché a quest’uomo venga risparmiata la vita.

Crediamo che per nessuna motivazione –religiosa, politica od etnica che sia- la pena capitale possa mai essere giustificata.

Per quanto efferato possa essere un crimine, e quantunque siano numerose le vittime –come nel caso di Amrozi- esso non può essere riparato con la morte del responsabile.

Con profondo rispetto vorremmo proporre alla Commissione per la Pena di Morte in Indonesia di tenere conto di quanto segue:

1. Prima di tutto, in quanto parte di una nazione religiosa, che rispetta i valori religiosi ed i comandamenti, riteniamo sia necessario per noi tutti rispettare ogni essere umano e intendiamo difendere il Diritto alla Vita. Infatti, la vita umana è un dono di Dio, il Creatore e Protettore della Vita. Dio dà la vita e solo Dio può toglierla, solo Dio ne ha l’assoluto diritto. Per questo, in quanto creature di Dio, siamo tutti chiamati a difendere il Diritto alla Vita.

2. Il Diritto alla Vita sta alla base di ogni considerazione etica. Senza il rispetto del Diritto alla Vita qualsiasi comportamento etico non ha alcun significato.

La vita non può essere tolta arbitrariamente, ogni condotta etica dovrebbe sempre onorare la vita in ogni forma e manifestazione

3. Molti studi dimostrano che la pena di morte non è un efficace deterrente contro i peggiori crimini, ed è questa una delle principali ragioni che spingono tanti paesi ad abolirla.

E’ significativo che nei paesi dove la pena capitale sia stata eliminata, il tasso di omicidi sia in effetti diminuito.

4. La pena di morte è una punizione definitiva e irreversibile e non dà alcuna possibilità ai giudici di commutare una condanna. E’ dimostrato che in tutti i paesi che adottano la pena capitale, anche persone innocenti possono essere messe a morte, e quando ciò accade, ai possibili errori dei tribunali non si può rimediare.

In base a tali considerazioni, sentiamo che è tempo per il Governo dell’Indonesia di abolire la pena di morte. E’ il provvedimento più saggio nell’ambito delle relazioni tra nazioni civilizzate.

Nel frattempo siamo qui a chiedere che l’esecuzione di Amrozi Bin H. Nurhasym venga immediatamente scongiurata e che la sua sentenza capitale sia trasformata in ergastolo.

Chiediamo anche a tutte le autorità indonesiane di commutare tutte le condanne a morte tuttora pendenti in Indonesia, in quanto costituiscono la violazione del principale diritto fondamentale, il Diritto alla Vita.

Vogliamo infine dire ancora una volta FERMIAMO SUBITO LA PENA DI MORTE. Non esiste alcuna ragione in assoluto per mantenerla.

Possa Dio Creatore e Protettore della Vita sostenere sempre il nostro impegno.

La Comunità di Sant’Egidio invita tutti ad aderire all’appello per salvare la vita di Amrozi dalla condanna a morte, inviando il seguente testo alle competenti autorità dell’Indonesia via fax o e-mail.

Stop the death penalty!

In the near future, Amrozi Bin H. Nurhasyim, charged as one of the main perpetrators of the Bali slaughter in 2002, could be executed.

We would like to present this statement just because we oppose the death penalty, and we want to stop the execution of this man.

Actually we think that no religious, political or ethical reason whatsoever can justify the death penalty.

Whatever heinous crime a man may have committed, even when the result is many victims, as Amrozi has done, cannot be punished with another death.

Respectfully, we want to propose to the death sentence committee in Indonesia to consider the following issues:

1) First of all, as a nation of religious people, who respect the religious values and commandments, we think it is necessary for us all to respect every life, and we want to defend the Right to Life. In fact, human Life is a gift from God, the Creator and the Protector of Life. God gives Life, and only God can take it away, only God has the absolute right to do that. Therefore, as God’s creation, we all are committed to defend the Right to Life.

2) The Right to Life is at the basis of every ethical consideration.

Without the respect of the Right to Life, the ethical conduct has no meaning.

Life cannot be taken arbitrarily, ethical conduct should always honor life in every form and dimension.

3) Many studies show that the death penalty is not a good deterrent against capital crimes, and this is one of the main reasons which urged several countries to abolish it.

It is meaningful that in the countries where the death penalty was abolished, the rates of homicides actually diminished.

4) The death penalty is ultimate and irreversible and doesn’t give any possibility to the judges to change a sentence. It is demonstrated that in all the countries where the death penalty is used, even innocent people can be executed, and when a person is executed, the possible court mistakes cannot be reversed.

Based on the above considerations, we feel that it is the time for the Indonesian government to abolish the death penalty. This is the wisest step in the relationship among the civilized nations.

In the meantime, we demand that the execution of Amrozi bin H. Nurhasyim be halted immediately, and that his sentence be commuted into life sentence.

We also call on the Indonesian authorities to commute all death sentences in Indonesia, as they constitute the violation of one the most fundamental of human rights - the Right to Life.

At the end we once again want to say, STOP THE DEATH PENALTY RIGHT NOW. There is absolutely no reason to continue it.

May God, the Creator and the Protector of Life, always help our good endeavor.

PERNYATAAN KEPRIHATINAN

Hentikan Hukuman Mati!

Dalam waktu dekat, jika tidak ada aral melintang, pemerintah akan mengeksekusi terpidana mati Amrozi yang dituduh bertanggungjawab atas peristiwa bom Bali tahun 2002. Rencana tersebut telah mengusik hati nurani kemanusiaan kami yang paling dalam, dan karena itu mendorong kami untuk membuat pernyataan ini: HENTIKAN HUKUMAN MATI!

Terlepas dari kesalahan yang dilakukan Amrozi dan peristiwa bom Bali yang telah memakan begitu banyak korban, menurut kami tidak ada landasan apapun, baik landasan agama, pertimbangan etis, maupun pertimbangan hukum yang dapat menjadi dasar pelaksanaan hukuman mati dan dapat dipertanggungjawabkan secara moral dan rasional. Sikap kami itu dilandasi argumen sebagai berikut, yang seyogianya menjadi pertimbangan para pelaksana hukuman mati di Indonesia:

Pertama, sebagai bangsa yang menjunjung tinggi nilai-nilai keagamaan, sudah selayaknya hak untuk hidup (right to live) menjadi nilai yang dijunjung tinggi oleh kita semua. Kehidupan merupakan pemberian Tuhan, Pencipta dan Pemelihara Kehidupan. Dan hanya Tuhan yang memiliki hak mutlak untuk mencabutnya. Sebagai makhluk ciptaan-Nya, sudah menjadi tugas kita untuk meluhurkan dan menjunjung tinggi hak untuk hidup yang diberikan oleh Sang Pencipta.

Kedua, hak untuk hidup juga merupakan landasan paling dasar bagi setiap pertimbangan etis. Tanpa penghormatan atas hak untuk hidup itu, maka tindakan etis tidak memiliki makna karena kehidupan dapat dengan semena-mena dicabut. Padahal kami meyakini, setiap tindakan yang bersifat etis merupakan upaya terus menerus untuk meluhurkan kehidupan dalam berbagai bentuk dan dimensinya.

Ketiga, berbagai studi yang pernah dilakukan memperlihatkan bahwa hukuman mati tidak menimbulkan “efek jera” yang diniatkan oleh ancaman hukuman tersebut. Dewasa ini, studi-studi tersebut justru memperlihatkan kecenderungan yang semakin besar dari berbagai Negara yang beradab untuk mencabut hukuman mati dari sistem peraturan dan perundang-undangan mereka.

Keempat, hukuman mati merupakan titik final yang tidak dapat ditinjau kembali, jika seandainya putusan hakim yang dijatuhkan ternyata salah. Banyak kasus yang terjadi baik di Indonesia maupun di luar negeri memperlihatkan bahwa kesalahan tersebut dapat saja terjadi. Dengan hukuman mati, kesalahan tersebut tidak dapat ditinjau dan diperbaiki. Itu berarti ada banyak kemungkinan di mana kita membunuh orang yang sesungguhnya tidak bersalah!

Berdasarkan pertimbangan-pertimbangan dasar tersebut, maka kami melihat sudah saatnya pemerintah Indonesia menghapuskan hukuman mati dari sistem peraturan dan perundangan di Indonesia. Langkah ini merupakan langkah paling bijak dalam pergaulan antar-bangsa yang lebih beradab.

Karena itu kami sekali lagi menyerukan, HAPUS HUKUMAN MATI SEKARANG JUGA! Tidak ada alasan apapun untuk mempertahankannya.

Semoga Tuhan, Pencipta dan Pemelihara Kehidupan, selalu menaungi upaya baik kita semua.
