NIGERIA: ASSOLTA GIOVANE CONDANNATA A MORTE PER LAPIDAZIONECORTE D'APPELLO:
INFONDATA SENTENZA PRIMA ISTANZA

E' stata assolta la giovane nigeriana condannata a morte per lapidazione perche' rimasta incinta al di fuori del matrimonio: una corte d'appello islamica della Nigeria ha deciso che Hajara Ibrahim, 18 anni, condannata a morte l'8 ottobre scorso da un tribunale islamico del villaggio di Lere, nello stato di Bauchi, non e' colpevole.

La sentenza di prima istanza, ha detto la corte di appello, era infondata e dunque non valida.

L'avvocato di Hajara Ibrahim ha sostenuto che non vi erano prove di adulterio poiche' il matrimonio combinato di Hajara con il suo sposo non era ancora stato consumato quando la ragazza ha avuto rapporti sessuali con un suo amico rimanendo incinta.

Hajara era stata condannata in base alla legge islamica (sharia) introdotta in molti stati della Nigeria alla fine degli anni Novanta.

Per il giudice Mohammed Mustapha Umar, che ha presieduto la seduta della corte d'appello, ha invece riconosciuto infondata e non valida la condanna a morte per lapidazione.

Abuja, - Una corte d'appello islamica nigeriana ha assolto una ragazza accusata di adulterio e condannata alla lapidazione. Hajara Ibrahim, 18 anni, era stata condannata lo scorso 8 ottobre da un tribunale coranico nel piccolo villaggio di Lere, nella regione di Bauchi, uno dei 12 stati nigeriani su 36 in cui vige la 'sharia', la legge islamica.

Nigerian Islamic court overturns stoning sentence

DASS, Nigeria, - An Islamic appeal court in Nigeria overturned a death by stoning sentence handed down to a pregnant woman for having sex out of wedlock, the judge said on Wednesday.

Judge Mohammed Mustapha Umar said the conviction of 29-year-old Hajara Ibrahim by the Lere lower court was unsound and set the woman free.

"This court has annulled the Lere lower court judgment," Umar said.

The lower court had sentenced Ibrahim to 100 lashes and death by stoning after she confessed to having unlawful sex with a 35-year-old man, Dauda Sani. Sani was released for lack of evidence.

Umar annulled the conviction on grounds it was incorrect to deliver the two sentences for the crime; the confession was void because it was not made four times; Ibrahim was not given the chance to defend herself and the investigation was not properly done.

"The court has therefore set Hajara free of all charges," Umar said.

Nobody has been lawfully stoned to death in Nigeria in the four years since 12 northern states introduced Islamic sharia law, because all such

sentences have been overturned on appeal.

DASS , - Une juridiction d'appel islamique du nord du Nigeria a acquitte mercredi Hajara Ibrahim, la jeune nigeriane enceinte qui avait ete condamnee a mort par lapidation pour adultere par un tribunal coranique, a-t-on appris de source officielle.

Hajara Ibrahim, 18 ans, avait ete condamnee a mort le 8 octobre par un tribunal coranique du village de Lere, dans l'Etat de Bauchi, un des douze Etats du pays - qui en compte 36 - a avoir retabli la charia (loi islamique) depuis 1999.

Son avocat, Abdulkadir Suleiman, avait plaide que l'adultere ne pouvait etre constate, le mariage arrange de Hajara avec son epoux n'ayant pas ete consomme quand elle avait eu des relations sexuelles avec son petit ami et etait tombee enceinte.

Le juge Mohammed Mustapha Umar, qui presidait la juridiction d'appel, a estime mercredi que le jugement de premiere instance etait infonde et l'a invalide.
