MARK LANKFORD - IDAHO (U.S.A.)

Mark Henry Lankford vive dal 1984 in assoluto isolamento nel braccio della morte del carcere di Boise, Idaho, condannato per duplice omicidio, reato del quale si è sempre dichiarato innocente. Il fratello Bryan, anch'egli inizialmente condannato per lo stesso delitto -e vero autore dello stesso- ha poi concluso un accordo con la procura che, in cambio dell'accusa nei confronti di Mark, gli ha consentito la revoca definitiva della condanna capitale. Sulla sua testimonianza è basata la condanna a morte di Mark, che non era neanche presente sul luogo del fatto. Successivamente Bryan ha ripetutamente ritrattato la sua versione, dicendosi unico autore del delitto e affermando senza equivoci che il fratello Mark non aveva commesso alcun omicidio e che le sue precedenti dichiarazioni erano false e mezzo per ottenere una riduzione della pena. Oggi però Bryan non viene ritenuto credibile, mentre i giudici d'accusa hanno successivamente negato ogni compromesso con lui. È accaduto così che la giuria non ha mai saputo che a Bryan sarebbe stata concessa una sentenza meno dura per la sua falsa testimonianza. Inoltre ha attribuito valore ad una testimonianza concordata, senza una verifica delle prove raccolte in giudizio. Mark, indigente e assistito da difensori d'ufficio, si batte per la revisione del processo. Non chiede la grazia, ma che gli sia consentito di provare la sua innocenza. 

L'avvocato difensore di Mark, Andy Parnes, sta cercando di ottenere una riapertura del processo. E' un passaggio critico per ribaltare l'accusa. Sarà utile qualsiasi forma di pubblicità sulle circostanze e sull'ingiustizia del caso di Mark. 

Per diverso tempo Mark ha portato avanti uno sciopero della fame che ha assai fiaccato le sue condizioni fisiche.

Mark H. Lankford is a convict sentenced to death by the State of Idaho on October 16, 1984 for murder.
His brother Bryan Lankford who carried out the murder has repeatedly declared being the only one responsible for the murder, stating his brother Mark’s innocence.
Despite this, Mark is still waiting for his execution in the death raw of the Boise Prison and his repeated appeals for a re-consideration of the sentence, so far, have always been rejected.
In the interest of justice and truth I am therefore presenting the following statement:
Mark H. Lankford is going through the last and decisive moments of his legal vicissitudes whereby he has the last chance to establish the truth about the facts concerning his trial. In any case, he should at least be given the consent to have his definite sentence revised.
I abstain from taking a stand on his case as well as from pronouncing a judgement on the result of his request.
However, it seems to me that the whole history of the trial presents a contradictory situation concerning the proof of Mark's guilt due to the fact that the prosecution has based its judgement on the declaration of Mark's brother Bryan Lankford who has repeatedly changed his version and even admitted having accused his brother in order to have his death sentence commuted.
In any case, elements proving Mark's participation in the double murder, do not seem to exist.
Moreover I know that Bryan Lankford has requested to be heard in order to provide information regarding his brother Mark's innocence, but being that both brothers have always been kept separated even Mark's attorneys have never been allowed to contact Bryan.
I cannot know the truth about the facts; however, being in front of such a precarious situation of proof I deem it proper and necessary that Mark Lankford's attorneys will be given all the possible chances to establish the truth.
Therefore, I trust that the Federal Judge will carefully consider the case for a solution in the interest of justice.
